Important: By making a donation to Mïam Charitable Trust through any channel — bank transfer, UPI, QR code, cheque, cash, or online platform — you confirm that you have read, understood, and irrevocably accepted these Terms in their entirety, including the Donation Terms, the Donor Warranties, and the No-Chargeback Policy. Please read this document fully before donating. If you do not agree, do not donate.
Mïam Charitable Trust is a public charitable trust recognised by the Government of India under Section 80G (URN: AAITM1924DF20231) and Section 12A (URN: AAITM1924DE20221) of the Income Tax Act, 1961, and registered with NITI Aayog (UID: MH/2024/0417254). Our objects, in summary, are charitable purposes within the meaning of Section 2(15) of the Income Tax Act, including education, animal welfare, environmental conservation, women's empowerment, and rural development.
You may use this website only for lawful, personal, non-commercial purposes. You must not:
Each Donation is made voluntarily, knowingly, and gratuitously by the Donor. No Donation is solicited, induced, or made in exchange for any goods, services, employment, preferential treatment, or other consideration of any kind from the Trust. The Donor expressly acknowledges that the Trust does not provide any product or service in return for the Donation, except a tax-exemption receipt where applicable under Indian law.
Once received and credited to the Trust's account, every Donation becomes the sole and absolute property of the Trust, is treated as irrevocable, and is applied immediately to the Trust's charitable objects. Accordingly:
The Trust will, at its sole and unfettered discretion, consider a refund only where all of the following are demonstrated by the Donor in writing within seven (7) calendar days of the transaction:
Refund requests under this clause must be sent to miamcharitabletrust@gmail.com and must include the transaction reference, bank/UPI confirmation, full identity proof, and a written declaration of error. Decisions of the Trust are final.
To prevent fraud, chargebacks, and unauthorised use of payment instruments, the Trust requires every Donor to furnish, at the time of Donation, (a) their 12-digit Aadhaar number, and (b) a clear photograph or scan of their Aadhaar card. This is processed solely for KYC, fraud-defence, and 80G-receipt purposes. The Aadhaar number is stored in masked form (last four digits visible) in administrative views; the full number and card image are kept in restricted-access storage and disclosed only on a need-to-know basis or as required by lawful authority. Donors who do not wish to share Aadhaar may decline to donate online and instead mail the Trust a cheque accompanied by alternative identity proof.
Donations from Indian taxpayers are eligible for tax deduction under Section 80G / 80GGA of the Income Tax Act, 1961, subject to applicable conditions. To receive an 80G receipt:
The Trust applies Donations to its charitable objects as the trustees in their sole discretion think fit, having regard to the Donor's stated preference (e.g. "Education", "Animal Welfare") where reasonably practicable. The Trust reserves the right to redirect funds to areas of greatest need where a designated programme is fully funded, suspended, or not feasible. Such redirection does not entitle the Donor to a refund.
By making a Donation, the Donor represents, warrants, and covenants to the Trust that, at the time of the Donation:
The Donor's warranties under this clause survive the Donation and are deemed repeated each time the Donor makes a further Donation.
The Donor irrevocably agrees that, having voluntarily made the Donation under these Terms, the Donor shall not:
The Donor agrees to fully indemnify and hold harmless the Trust, its trustees, employees, volunteers, bankers, and payment processors from and against any and all losses, costs, expenses, damages, fees (including legal fees on a full-indemnity basis), penalties, freezes, holds, account suspensions, or reputational harm suffered by them arising out of or in connection with:
Without limiting the generality of the above, if any bank account, payment instrument, or wallet of the Trust is frozen, debited, or held by reason of a complaint, dispute, or chargeback initiated by the Donor in breach of these Terms, the Donor shall, on demand, pay the Trust an amount equal to the frozen, debited, or held sum, together with all costs, charges, and consequential losses suffered by the Trust.
The parties acknowledge that quantification of harm caused by an unmeritorious chargeback or false-fraud complaint is inherently difficult. The parties accordingly agree, as a genuine pre-estimate of damages and not as a penalty, that the Donor shall be liable to pay the Trust:
The Trust will fully cooperate with any lawful enquiry by the Reserve Bank of India, the Financial Intelligence Unit, the Cyber Crime Cell, the Income Tax Department, the Ministry of Home Affairs, or any other competent authority. The Donor consents to the Trust disclosing the Donor's Donation record, identity details, IP address, device information, and consent log to such authorities to verify the lawfulness of the Donation, and waives any privacy claim against the Trust for such disclosure made in good faith.
The Donor agrees that:
Volunteer applications submitted through the website are subject to availability and programme suitability. The Trust reserves the right to accept or decline any application without obligation to provide reasons. Volunteers are not employees of the Trust and receive no monetary compensation. The Trust accepts no liability for accidents, illness, theft, or loss suffered by a volunteer during voluntary engagements, save where the Trust is liable under mandatory law.
All content on this website — including text, images, photographs, graphics, logos, names, marks, video, audio, and code — is the property of the Trust or its licensors. You may view and download content for personal, non-commercial use only. Any other use, reproduction, redistribution, framing, or scraping requires the Trust's prior written consent.
The website may contain links to third-party platforms (YouTube, social-media networks, payment gateways, banks, UPI apps). The Trust does not control and is not responsible for the content, security, privacy practices, or availability of those platforms. Use of such platforms is at the Donor's own risk.
The website is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, the Trust, its trustees, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or in connection with the website or any Donation, even if the Trust has been advised of the possibility of such damages.
The Trust is not liable for any failure or delay in performing its obligations caused by events beyond its reasonable control, including acts of God, earthquakes, floods, fires, pandemics, civil disturbance, war, terrorism, government action, banking-system failure, internet or telecommunication outage, or change of law.
These Terms are governed by the laws of the Republic of India.
Any dispute, controversy, or claim arising out of or relating to these Terms or any Donation, including its existence, validity, interpretation, performance, breach, or termination, shall first be attempted to be resolved through good-faith negotiation between the parties for thirty (30) days.
Failing such resolution, the dispute shall be referred to and finally resolved by arbitration administered under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by the Trust. The seat and venue of arbitration shall be Mumbai, Maharashtra; the language shall be English; and the award shall be final and binding on the parties.
Subject to the arbitration clause above, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any matter not capable of arbitration.
If any provision of these Terms is held by a court or tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be construed, to the maximum extent permitted by law, in a manner that gives effect to the original intent of the parties.
These Terms, together with the Privacy Policy and the consent record generated at the time of Donation, constitute the entire agreement between the Donor and the Trust in respect of any Donation, and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
The Trust may revise these Terms from time to time. The current version is always posted on this page with an updated date and version number. The Terms in force at the time of a Donation govern that Donation; subsequent changes do not retroactively affect prior Donations.
Any grievance regarding these Terms or a Donation may be addressed to the Trust's Grievance Officer:
The Grievance Officer will acknowledge receipt within seventy-two (72) hours and aim to resolve the matter within fifteen (15) working days.
Acceptance. By proceeding to donate, you confirm that you have read this entire document, understood it, and accept it as a binding agreement between you and Mïam Charitable Trust. If you do not understand any clause, please email us before donating.
